เอกสารนี้ ("ข้อเสนอ") เป็นข้อเสนออย่างเป็นทางการโดย Delivery Service Phangan Co LTD (DBD 0845559002570) ("Delivery KPG") เพื่อเข้าสู่ข้อตกลงระหว่าง Delivery KPG กับคุณ ("พันธมิตร") ตามข้อกำหนดและเงื่อนไขที่กำหนดไว้ใน ข้อเสนอนี้
• วางข้อมูลเกี่ยวกับผลิตภัณฑ์ของพันธมิตรบนแพลตฟอร์มการจัดส่งของ KPG (แพลตฟอร์ม) โดยมีค่าธรรมเนียม (ค่าคอมมิชชัน)
• เปิดโอกาสให้พันธมิตรในการรับคำสั่งซื้อผ่าน WhatsApp หรือแอปพลิเคชัน Delivery KPG RESTO;
• ให้การสนับสนุนทางเทคนิคแก่คู่ค้าในการทำงานกับแพลตฟอร์ม (ความช่วยเหลือในการประมวลผลคำสั่งซื้อ การปรับปรุงรายการราคาสำหรับสินค้าและบริการที่เผยแพร่บนแพลตฟอร์ม การฝึกอบรมพนักงาน)
• การจัดส่ง KPG ให้บริการเฉพาะการส่งมอบผลิตภัณฑ์ที่สั่งซื้อจากคู่ค้าซึ่งมีหน้าที่ต้องปฏิบัติตามกฎหมายทั้งหมดของราชอาณาจักรไทยที่เกี่ยวข้องกับการควบคุมการค้ากัญชง (กัญชา) ภายในอาณาเขตของราชอาณาจักรไทย ให้กับผู้ซื้อ
• ชำระค่าสินค้าและจัดส่งให้ผู้ซื้อเป็นเงินสดเท่านั้น เพื่อยืนยันว่าผู้ซื้อมีอายุเกิน 20 ปีบริบูรณ์และไม่ได้ตั้งครรภ์;
• คนขับอาจปฏิเสธที่จะดำเนินการจัดส่งให้เสร็จสิ้น หากผู้ซื้อไม่สามารถยืนยันได้ว่าพวกเขามีอายุเกิน 20 ปี;
• จัดทำรายงานคำสั่งซื้อที่เสร็จสมบูรณ์เดือนละ 2 ครั้งในรูปแบบอิเล็กทรอนิกส์
• ค่าคอมมิชชั่น Delivery KPG คือ 10% ของคำสั่งซื้อที่เสร็จสมบูรณ์ทั้งหมดบนแพลตฟอร์ม (จัดส่งโดย Delivery KPG หรือรับด้วยตนเอง)
• ค่าคอมมิชชั่นจะคำนวณสองครั้งต่อเดือนตามคำสั่งซื้อที่เสร็จสมบูรณ์ทั้งหมดบนแพลตฟอร์มตั้งแต่วันที่ 1 ถึงวันที่ 15 และตั้งแต่วันที่ 16 ถึงวันสุดท้ายของเดือน
• รายงานจะถูกส่งในรูปแบบอิเล็กทรอนิกส์ทุกวันที่ 1 และ 16 ของทุกเดือน
• การชำระค่าคอมมิชชั่นทำได้โดยการโอนเงินจำนวนดังกล่าวไปยังบัญชี Delivery KPG ภายใน 3 วันนับจากวันที่ได้รับรายงาน
• พันธมิตรมีสิทธิ์ที่จะส่งการเรียกร้องที่มีเหตุผลเกี่ยวกับคำสั่งซื้อ KPG ค่าใช้จ่ายของบริการสามารถตรวจสอบโดยคู่สัญญา
ค่าคอมมิชชัน = 10% * (ต้นทุนของคำสั่งซื้อที่มีการจัดส่ง KPG หรือมารับเองในช่วงสองสัปดาห์ปฏิทินที่ผ่านมา)
• ในกรณีที่เกิดปัญหาทางเทคนิคบนแพลตฟอร์มหรือบริการมากเกินไปเนื่องจากสภาพอากาศ ให้ระงับการรับคำสั่งซื้อจนกว่าปัญหาจะได้รับการแก้ไข
• ในกรณีที่พบว่าพันธมิตรมีส่วนร่วมในกิจกรรมที่ผิดกฎหมาย ข้อตกลงสามารถยุติได้โดยฝ่ายเดียว;
• ในกรณีที่จ่ายค่าคอมมิชชั่นล่าช้า ให้บล็อกบัญชีของพันธมิตรบนแพลตฟอร์มจนกว่าจะชำระหนี้
• ปฏิบัติตามกฎหมายทั้งหมดของราชอาณาจักรไทยที่ควบคุมการจำหน่ายกัญชง (กัญชา) ในอาณาเขตของราชอาณาจักรไทย;
• จัดส่ง KPG พร้อมชุดเอกสารเต็มรูปแบบ เช่น ใบอนุญาตจากเลขาธิการสำนักงานคณะกรรมการอาหารและยา (FDA) สำหรับการเพาะปลูกและการขายกัญชา การอนุญาตให้พันธมิตรดำเนินกิจกรรมเพื่อวัตถุประสงค์ในการประเมิน ความถูกต้องตามกฎหมายของความร่วมมือกับพันธมิตร รวมถึงข้อมูลอื่น ๆ ที่จำเป็นสำหรับการจัดวางบนแพลตฟอร์ม
• รับผิดชอบอย่างเต็มที่สำหรับการไม่ปฏิบัติตามข้อกำหนดทางกฎหมายของราชอาณาจักรไทย;
• จ่ายค่าคอมมิชชั่นการจัดส่ง KPG เป็นจำนวน 10% ของคำสั่งซื้อที่เสร็จสมบูรณ์ทั้งหมดบนแพลตฟอร์ม
• คุณภาพและมาตรฐานของผลิตภัณฑ์ที่เผยแพร่บนแพลตฟอร์มต้องเป็นไปตามประกาศของกระทรวงสาธารณสุข โดยเฉพาะเนื้อหา THC ซึ่งไม่ควรเกิน 0.2% โดยน้ำหนักแห้ง:
• ไม่อนุญาตให้มีมาร์กอัปที่ซ่อนอยู่ในผลิตภัณฑ์บนแพลตฟอร์ม ต้นทุนของผลิตภัณฑ์จะต้องสอดคล้องกับรายการราคาอย่างเป็นทางการ
• ให้ข้อมูลเกี่ยวกับการเปลี่ยนแปลงในช่วงและต้นทุนของผลิตภัณฑ์ที่เผยแพร่บนแพลตฟอร์มโดยทันที;
• รายงานปัญหาทางเทคนิคหรือปัญหาอื่น ๆ ที่เกี่ยวข้องกับการจำกัดหรือการไม่สามารถรับคำสั่งซื้อที่ดำเนินการบนแพลตฟอร์ม;
• ในกรณีที่จำเป็นต้องส่งซ้ำให้ลูกค้าเนื่องจากความผิดพลาดของพาร์ทเนอร์ (ส่วนหนึ่งของคำสั่งซื้อที่พลาด ส่งสินค้าผิด) พาร์ทเนอร์จะจ่ายเงิน 58 บาทให้กับผู้จัดส่งสำหรับแต่ละกรณีของการจัดส่งดังกล่าว
• คิดค่าธรรมเนียมบรรจุภัณฑ์ที่เหมาะสม ค่าธรรมเนียมคงที่ต่อการสั่งซื้อ
• ยกเลิกสัญญาโดยแจ้ง Delivery KPG ล่วงหน้า 7 วัน
มีผลิตภัณฑ์มากมายที่มีกัญชา เช่น เมล็ดพืช อาหารเสริม และเครื่องสำอางที่สามารถขายออนไลน์บนแพลตฟอร์มได้ ความรับผิดชอบของเราต่อผู้บริโภคคือเพื่อให้แน่ใจว่าผลิตภัณฑ์กัญชาเป็นไปตามมาตรฐานองค์การอาหารและยาและได้รับอนุญาตจากสำนักงานคณะกรรมการอาหารและยา ในการทำเช่นนี้ เราจำกัดผลิตภัณฑ์ที่สามารถขายบนแพลตฟอร์มของเราได้

จากประกาศกระทรวงสาธารณสุข เรื่อง พระราชบัญญัติยาเสพติดให้โทษ (กัญชา) พ.ศ. 2565 ซึ่งมีผลบังคับใช้เมื่อวันที่ 17 มิถุนายน 2565 กำหนดให้กัญชาหรือสารสกัดจากพืชกัญชาจัดเป็นสมุนไพรควบคุม ซึ่งหมายความว่าผู้ขายกัญชาจะต้องปฏิบัติตามกฎหมายที่เกี่ยวข้อง และห้ามขายกัญชาให้กับใครก็ตามที่:
1.บุคคลที่มีอายุต่ำกว่า 20 ปี;
2.สตรีมีครรภ์;
3.ผู้หญิงที่กำลังให้นมบุตร
1.แสดงเลข อย. ที่ถูกต้องในภาพหรือรายละเอียดสินค้า
2.แสดงฉลากภาษาไทยให้ถูกต้อง
3.แนบใบอนุญาตต่างๆ ไปกับรูปภาพผลิตภัณฑ์
4.ต้องไม่มีการกล่าวอ้างเกินจริงหรือเป็นเท็จ
This document ("Offer") is an official offer by Delivery Service Phangan Co LTD (DBD 0845559002570) ("Delivery KPG") to enter into an AGREEMENT between Delivery KPG and you ("Partner") on the terms and conditions set forth in this Offer.
•place information about the Products of the Partner on the KPG Delivery Platform (Platform) for a fee (Commission);
•provide the partner with the opportunity to accept orders via WhatsApp or the Delivery KPG RESTO application;
•provide technical support to the partner in working with the Platform (assistance in processing orders, updating the price list for goods and services published on the Platform, staff training);
•Delivery KPG provides only the service of delivering Products that have been ordered from a Partner who is obliged to comply with all the laws of the Kingdom of Thailand related to the regulation of the hemp (marijuana) trade within the territory of the Kingdom of Thailand, to the buyer.
•payment for goods and delivery to the buyer is made only in cash to confirm that the buyer is over 20 years of age and not pregnant;
•the driver may refuse to complete the delivery if the buyer is unable to confirm that they are over 20 years of age;
•provide a report on completed orders twice a month in electronic format.
•the Delivery KPG commission is 10% of all completed orders on the Platform (delivered by Delivery KPG or self-pickup);
•the commission is calculated twice a month based on all completed orders on the Platform from the 1st to the 15th inclusive and from the 16th to the last day of the month;
•the report is sent in electronic format on the 1st and 16th day of each month;
•payment of the commission is made by transferring the amount to the Delivery KPG account within 3 days from the receipt of the report;
•the Partner has the right to send Delivery KPG a reasoned claim regarding the Order, the cost of services can be reviewed by the Parties.
Commission = 10% * (the cost of orders with Delivery KPG delivery or self-pickup over the past two calendar weeks).
•in case of technical problems on the Platform or overload of the service due to weather conditions, suspend the acceptance of orders until the problems are resolved;
•in case it is discovered that the Partner is engaged in illegal activities, the agreement can be unilaterally terminated with them;
•in case of delay in paying the commission, block the Partner's account on the Platform until the payment of the debt.
•comply with all laws of the Kingdom of Thailand regulating the circulation of hemp (marijuana) on the territory of the Kingdom of Thailand;
•provide Delivery KPG with a full package of documents, such as a license from the Secretary-General of the Food and Drug Administration (FDA) for the cultivation and sale of cannabis, allowing the Partners to conduct their activities for the purpose of evaluating the legality of cooperation with the Partner, as well as other information necessary for placement on the Platform;
•bear full responsibility for non-compliance with any legislative requirements of the Kingdom of Thailand;
•pay Delivery KPG commission in the amount of 10% of all completed orders on the Platform;
•the quality and standards of the Products published on the Platform must comply with the statement of the Ministry of Public Health, especially the THC content, which should not exceed 0.2% by dry weight:
•do not allow hidden markups on Products on the Platform. The cost of the Products shall correspond to the official price list;
•promptly provide information about changes in the range and cost of the Products published on the Platform;
•report any technical or other problems related to the restriction or inability to accept orders placed on the Platform;
•in cases where re-delivery to the Client is required due to the fault of the Partner (part of the order was missed, the wrong product was delivered), the Partner pays 58 THB to the courier for each case of such delivery.
•charge reasonable packaging fees. Fixed fee per order;
•terminate the agreement by notifying Delivery KPG 7 days in advance.
There are many products containing cannabis such as seeds, dietary supplements and cosmetics that can be sold online on the Platform. Our responsibility to consumers is to ensure that cannabis products meet FDA standards and are licensed by the Food and Drug Administration. To do this, we limit the products that can be sold on our platform.
•Cannabis/marijuana seeds that are not intended for cultivation, such as for use as animal feed;
•Marijuana oil or essential oil.

According to the announcement of the Ministry of Public Health regarding the Narcotics Act (Marijuana) of 2022, which came into effect on June 17, 2022, marijuana or extracts from the Cannabis plant are classified as controlled herbs. This means that marijuana sellers must comply with relevant laws and it is prohibited to sell marijuana to anyone who:
1.Individuals who are under 20 years old;
2.Pregnant women;
3.Women who are breastfeeding.
