Content, CEO™ Payment Plan Agreement
This Payment Plan Agreement (the "Agreement") is a legally binding contract between Pixistock, LLC (“Pixistock”) and the undersigned ("Member") for the purchase of the Content, CEO™ lifetime membership (the “Membership”).
The terms and conditions set forth in the Pixistock Terms of Use are incorporated by reference into this Agreement. Member understands and agrees that this payment plan Agreement does not in any way nullify or alter Pixistock's Terms of Use. In the event of any inconsistency, ambiguity, or conflict between the Terms of Use and the terms of this payment plan Agreement, the terms of this payment plan Agreement will govern, but only to the extent relating to Content, CEO™ payment issues. For all other issues, the provisions of the Term of Use will govern.
Payment Plan
Member understands and agrees that the purchase of the Membership will be made in 12 equal installment payments on the total amount agreed to at checkout with the first payment being due at checkout. Pixistock accepts credit cards through our Stripe payment gateway only for payment plan payments of Membership. The subsequent 11 payments will be billed per month on the same day of the month as the first payment for the remaining 11 months.
Member understands and agrees that they are responsible for ensuring that there are sufficient funds available to cover each of the 11 remaining payments.
Payment Method
Member will provide Pixistock with valid payment method information and it is Member’s responsibility to maintain valid payment information in Member’s Membership account. If a payment is denied due to an expired or otherwise invalid payment method, Member’s Membership account will be considered delinquent and access to Pixistock premium content will be restricted immediately. Member may reinstate the Membership account by contacting Pixistock at support@pixistock.com.
Failure to Pay
Member understands and agrees that any payment rejected by their banking institution for “Insufficient Funds,” “Stop Payment,” “Account Closed” or any other reason will immediately cause the account to become delinquent and Member will be restricted from accessing Pixistock premium content. Pixistock will not be liable for any bank or credit card fees or charges for insufficient funds or credit.
Member understands and agrees that Pixistock will make four total attempts to collect the missed payments and upon the fourth failed attempt to collect payment, Member’s Membership will be cancelled. Once cancelled, all future attempts to collect on the delinquent account will cease and Member’s Membership will be cancelled and Member will no longer have access to Pixistock’s premium content under the Content, CEO™program. If Member is experiencing financial hardship causing difficulty in paying Membership fees, Pixistock offers a “Pause Payment” option. See below for details.
In the event of a “charge-back,” Pixistock shall, in its sole discretion charge a fee of $25. In the event of a charge-back, Pixistock will employ any and all remedies available to it under applicable law and/or bank or credit card issuer policies. To the extent permitted by law, a charge-back may be considered a material breach of the Agreement.
The Member understands that unapproved failure to pay is a material breach of this Agreement and Member will forfeit all prior Membership payments made for a breach of any payment term under this Agreement.
Cancellations and Refunds
Member understands and agrees that they have 7 days from the initial purchase date to request a cancellation and full refund of the first payment. Member understands and agrees that after 7 days from initial purchase they will no longer qualify for any amount of refund. Cancellation requests must be submitted no less than 1 day BEFORE the date the next monthly payment is scheduled; no exceptions. There are no refunds of payments once a payment is processed and only future payments will be paused; no exceptions. Upon notice of cancellation, all future payments will cease and the Member understands that they will lose access to Pixistock's premium content.
Member understands and agrees that if their Membership account is cancelled due to Member’s (1) delinquent payment; (2) request to cancel; or (3) initiation of cancellation on the Member dashboard, they have up to 1 year from the effective date of the cancellation to restart payment of the remaining balance due under the Agreement and have their Membership reinstated at their existing price. If Member requests reinstatement after 1 year of cancellation under this section, Pixistock retains the right to increase the Member’s price to and charge to reinstate to no more than the price of all new customers with the same plan at that time for reinstatement.
Pause Payment
Member may request a pause of the installment payments agreed to in the Payment Plan section if Member reports they are negatively impacted by a financial hardship. It is in Pixistock’s sole discretion whether to grant Member such a pause of payment. If a pause is granted, the Member will have up to 1 year to restart the payment plan of the remaining balance due from the initiation of the pause period. At the conclusion of the 1 year pause period, if Member has not successfully restarted the payment plan, Pixistock retains the right to increase the total payment amount due for Member’s Membership to no more than the price being charged to all new customers with the same plan at that time.
Member understands and agrees that requests to pause payment under this section will not result in cancellation of Member’s Membership, but only act as a temporary restriction placed on the Member's Membership account. The Member will not have access to Pixistock's premium content during the pause period. Access will be fully restored once Pixistock has received full payment equivalent to the next payment plan amount due.
For all matters relating to a pause of payment – both to initiate and cancel such pause - please contact support@pixistock.com. Note that in order to stop payment before it occurs, pause initiation requests must be submitted no less than 1 day BEFORE the date the next monthly payment is scheduled; no exceptions. There are no refunds of payments once processed and only future payments will be paused; no exceptions.
Accelerated Payments
Member understands and agrees that Pixistock allows accelerated payment of Member’s Membership if the Member wishes to pay off the balance faster than the 1 year provided. Member must make a request to Pixistock to make accelerated payments. These requests are to be submitted to support@pixistock.com and it is in the sole discretion of Pixistock whether to allow accelerated payment and, if allowed, what terms will apply. If payment acceleration is approved by Pixistock, Member’s payment obligation under this Agreement will be deemed fully satisfied upon successful payment of all amounts due and owing under the Agreement and, unless the Agreement is amended to add further charges, no further charges will be assessed to Member.
Pay-in-full
Member understands and agrees that they have 30 days to take advantage of the lower pay-in-full price from the initial checkout date. If Member opts to pay-in-full, their payment obligations under the Agreement will be deemed fully satisfied upon successful payment of all amounts due and owing under the Agreement within 30 days and, unless the Agreement is amended to add further charges, no further charges will be assessed to Member.
