Membership Activation
Members will receive an email within 7 days after the first initial scheduled 1-on-1 "activation call". for the Sky’s Travel Club Membership Program. This email will include login credentials to the Sky’s Travel Club members only website Sky’s Travel Club. By signing off on this application, I acknowledge and agree to Sky’s Travel Club, LLC Terms and Conditions and authorize Sky’s Travel Club, LLC to contact me regarding my membership. By purchasing a Membership through Sky’s Travel Club, LLC buyer agrees to be bound by the Terms and Conditions of the Membership which are subject to change at Sky’s Travel Club, LLC’s sole discretion. Depending on the type of Membership purchased, redeeming certain benefits may require additional fees. Member’s account will remain active and in good standing so long as all of the following are satisfied: (a) the Member is current in the payment of all amounts due in connection with the Program, (b) the Member is in compliance with all applicable Membership Documents, (c) the Member’s Membership is not suspended or terminated, and (d) the Member’s Membership Term has not expired without renewal. Suggested Membership Terms to be Added
Agreement to Buy and Sell; Membership Type and Benefits: For and in consideration of the Purchase Price, Buyer agrees to purchase, and Sky’s Travel Club agrees to sell to Buyer, a “Membership” in the Sky’s Travel Club, LLC Membership (“Program”), subject to the terms of this Agreement. Each Membership is assigned a Membership Type, and Buyer’s Membership Type is indicated on the face of this Agreement. Each Membership contains the above listed “Membership Benefits.” Specific Membership Benefits may vary based upon Membership Type, as described in the Membership Documents. Sky’s Travel Club, LLC reserves the right to create separate policies governing each Membership Type. Each Membership is assigned a personalized “Membership Account” and corresponding number evidencing each Member’s Membership and benefits.
Travel Fulfillment Services
The travel fulfillment benefits offered through your Membership are fulfilled by a third party Arrivia, Inc. (“Arrivia"). Arrivia is located at 15147 N. Scottsdale Road, Suite 210, Scottsdale, AZ 85254. Arrivia is a registered seller of travel in the following states: Florida #ST-29452, Washington UBI#602 443 155 001 0001, Hawaii #TAR-5192 (Hawaiian travel agency trust account named Client Trust Account #21- 136301), and California #CST 2066521-50. Registration as a seller of travel does not constitute approval by the State of California. Arrivia is not a participant in the California Travel Consumer Restitution Fund. California requires certain sellers of travel to have a trust account or bond. Arrivia maintains a Consumer Protection Bond issued by International Fidelity Insurance Company in the amount of $100,000.00.
Renewal Automatic Program; Failure to Renew:
Buyer’s “Membership Term” shall begin on the Effective Date and shall end on the twelve (12) month anniversary thereof. While in Good Standing under this Agreement, Buyer may NOT elect to exercise an optional renewal of Buyer’s Membership. In the sole discretion of Sky’s Travel Club, LLC, the Annual Membership Fee may change. As of the effective date of this Agreement, the Annual Membership Fee is waived.
Customary Charges
In addition to all other Buyer payment obligations hereunder, Buyer shall pay all fees, costs, taxes, and other customary charges associated with this Agreement and Buyer's purchase of Buyer's Membership (e.g., sales taxes). Buyer is solely responsible for payment of all taxes, fees or similar charges imposed by any municipality, state, federal or other government authority in connection with Buyer’s receipt of Membership Benefits, including, for example, payment of all arrival or departure taxes, transient occupancy taxes, sales taxes and similar charges. As a convenience to you, such charges may be collected by Sky’s Travel Club, LLC at the time of purchase. Similarly, in addition to the purchase price for Rewards Benefits, Members must pay all applicable shipping and handling costs as provided on the Sky’s Travel Club, LLC Website. Buyer is also solely responsible for payment of all personal charges in connection with its receipt of Membership Benefits such as transportation, transfers, food and beverage, telephone, upgrades, and any and all other charges required to be paid by Buyer as otherwise provided in the applicable Membership Documents.
Consent to Solicitation
By signing below, I/ We, the Buyer or Buyers, verify that I/ We are over 21 years of age. I verify that the telephone numbers provided are my telephone number(s) and acknowledge that Sky’s Travel Club LLC collects this information. I consent to receive autodialed and/or pre-recorded telemarketing calls and text messages at the telephone numbers provided concerning products and services offered by or on behalf of Sky’s Travel Club, LLC, and its third-party services providers including Arrivia, Inc. I understand that all calls are monitored and recorded for quality assurance purposes, and I consent to such monitoring and recording. I understand that consent is not a condition of purchase.
Incentives
All incentives such as any gifts, complimentary gifts, bonuses, and prizes given during the purchase agreement must be returned or void unless Member’s account will remain active and in good standing so long as all of the following are satisfied: (a) the Member is current in the payment of all amounts due in connection with the Program, (b) the Member is in compliance with all applicable Membership Documents, (c) the Member’s Membership is not suspended or terminated, and (d) the Member’s Membership Term has not expired without renewal. Whichever occurs first.
